Fundamental and human rights

Grund- und Menschenrechte

We support citizens with legal means in enforcing their fundamental and human rights vis-à-vis authorities and in court. We fight to ensure that violations of these rights are recognised as such, whether in administrative, press or criminal law. We advise civil society actors on constitutional issues and matters relating to fundamental and human rights.

The German Constitution (Grundgesetz), the state constitutions and international human rights agreements form the basis of our legal system. They not only safeguard democracy and the rule of law, but also guarantee enforceable fundamental and human rights such as freedom of expression and information. As directly applicable law, they are binding on all authorities and courts.

When all legal remedies have been exhausted, in some cases the last resort is to lodge a constitutional complaint with the state or federal constitutional court or a human rights complaint with the European Court of Human Rights. The success rate for such complaints is extremely low, partly because the procedural hurdles are high. However, we have many years of experience with constitutional and human rights complaints, have already won several cases and are familiar with the pitfalls that need to be avoided. This enables us to reliably assess the chances of success and significantly increase them. To this end, it is important that you approach us at an early stage, if possible while proceedings are still ongoing before the ordinary courts or administrative courts.

We also provide support in constitutional law, for example in the area of information rights of members of parliament.
